RULES OF “TSL MUSIC FESTIVAL”

I. General Provisions

  1. These Rules (hereinafter referred to as the “Rules”) apply to all participants of the non-mass event under the name of “TSL Music Festival” (hereinafter referred to as “the Event”), organized by ESA Trucks Polska Sp. z o.o. with its registered office in Komorniki, ul. Ks. Wawrzyniaka 1 (hereinafter referred to as the “Organizer”).
  2. The event is held in Concordia Design building, ul Zwierzyniecka 3, 60-813 Poznań. The detailed description of the event venue and other useful information about the Event can be found at www.TSLMusicFestival.com
  3. The Event does not have a character of a mass event (within the meaning of the Law on the Safety of Mass Events of March 20, 2009), and the number of places made available by the Organizer does not exceed 490.
  4. Admission to the TSL Music Festival is possible by presenting an invitation issued by the Organizer to its customers (the so-called VIP Area) and by presenting a ticket available for sale (the so-called OPEN Area). The Organizer provides for two stages of ticket sales (OPEN Area): Stage I – sale only to companies from the TFL sector (Transport – Forwarding – Logistics), to which the Organizer will offer tickets; Stage II (will be carried out as long as there are unsold tickets left from Stage I) – open sale on the eBilet platform: ebilet.pl.  The total number of invitations and tickets will not exceed 490.

 

  1. Entering the Event means accepting the provisions of the Rules and the obligation to follow the instructions issued by the Organizer and persons authorized by him.
  2. The Rules of the Event are available on the Event website at www.TSLMusicFestival.com.
  3. The Event has an artistic and entertainment character and a detailed description of the program of the Event can be found on the aforementioned website.

II. Organizational rules and regulations applicable at the Event

  1. All persons present at the Event shall behave in a manner that does not endanger the safety of other persons, and in particular they shall comply with the provisions of the Rules, generally applicable law with the recommendations of the Organizer’s representatives issued to ensure their safety and order.
  2. Persons present at the Event shall have a valid document confirming their identity and age. No minors are allowed at the Event. Therefore, the Organizer’s representatives have the right to check identification documents of persons present at the Event. Minors will be asked to leave the Event.
  3. Persons present at the Event shall respect the property of other people, equipment, all other technical devices and installations as well as the property of the Organizer. In the event of damage, the Organizer’s representatives will be entitled to check the identification document of the person responsible for the damage. In the event of a refusal to provide an identity document, the Police will be called in.
  4. At the first entry to the Event, an invitation issued by the Organizer or a ticket purchased in free sale shall be presented. Presented invitations and tickets will be exchanged to an ID at the entrance to the Event. The ID will have the form of a band, the pattern of which is defined by the Organizer, placed permanently on the wrist. The bands will be in two types: for VIP clients (in exchange for an invitation) and for other persons (in exchange for a ticket). Only one person can use the ID.Each entry to the Event is permitted only with an undamaged ID fixed permanently on the wrist. Damaging or breaking the ID causes its expiration. It is forbidden to transfer the ID to another person. The exchange of an invitation or ticket for the ID can be made only in person. Only original invitations and tickets are subject to exchange to the ID, which is verified at the first entry to the Event.
  5. Persons present at the Event shall wear the ID on the wrist. The lack of an ID or possession of a broken or damaged ID, as well as an ID not attached on the wrist constitutes an unequivocal grounds for removing the person from the Event. In the event of breaking or damaging the ID (at the Event), a person with such an ID shall immediately report to the Organizer’s representative together with the damaged ID, in order to exchange the ID to the new one. Only IDs damaged at the Event and not outside its area are replaced. Unauthorized leaving the Event with a damaged or broken ID without prior notification of the Organizer’s representative is equivalent to the resignation from participation in the Event.
  6. The Organizer is not responsible for the items left on the premises of the Event.
  7. Persons present at the Event shall use the sanitary facilities only for their intended purpose.
  8. During the Event, it is forbidden to bring in and possess:
  • weapons or other dangerous objects (e.g. knives, sharp tools, gas, etc.);
  • explosives;
  • pyrotechnic products;
  • fire-hazardous materials;
  • narcotic drugs or psychoactive substances;
  • other objects or substances whose possession is prohibited by generally applicable regulations.
  1. No dogs or any other animals are allowed on the Event.
  2. It is prohibited to bring in any drinks or any food to the Event.
  3. It is prohibited to conduct any commercial or other gainful activities as well as advertising and promotional activities at the Event without the consent of the Organizer.
  4. At the Event it is possible to purchase drinks and food by paying in cash or by card. The Organizer has prepared a wide range of alcohols and other beverages as well as hot and cold snacks for VIP ticket holders.
  5. It is forbidden to record any part of the Event using professional photo cameras, video cameras or other equipment which allows for audio-video recording. It is allowed to take photos from the Event using amateur digital cameras with optical zoom below 6x.
  6. Violation of the Rules or failing to follow the recommendations of the representatives of the Organizer or security services can result in particular in:
  • requesting the person present at the Event to leave it;
  • apprehending the person present at the Event and handing them over to external services (in particular to the Police).
  1. Persons present at the Event may be exposed to continuous sound which may damage hearing or cause other health problems. The Organizer is not responsible for the aforementioned damage to health caused by loud sounds.
  2. The Organizer will record the course of the Event for the purposes of documentation and promotion or advertising of the Event and the future events of the Organizer, as well as for promotional and marketing purposes of the business activity of the Organizer. The image of persons on the premises of the Event can be recorded and then distributed for documentary, reporting, advertising and promotional purposes related to the Event or business activity of the Organizer. The image of persons will be distributed as constituting only a detail of the whole Event and therefore not requiring the person’s consent for its distribution (in accordance with Article 81, paragraph 2, point 2 of the Copyright and Related Rights Act).
  3. In the event of loss of persons or property, please report to the Organizer’s representatives or the information desk at the main entrance.
  4. All problems and queries regarding the course of the Event should be reported to the security services appointed by the Organizer.

III. Representative and security services appointed by the Organizer

  1. Representatives of the Organizer and appointed security services will have IDs issued by the Organizer.
  2. Organizer’s services include security personnel and persons at the entrance to the Event responsible for checking invitations and tickets and providing all information related to the Event. The aforementioned services are entitled to check compliance with all rules of the Event described in the Rules.
  3. Representatives of the Organizer and security services appointed by him will carry out information duties related to the Event, as well as other obligations resulting from the Rules of the Event.

IV. Personal data processing

  1. The Organizer of the Event will process the following personal data of persons participating in the Event: the image recorded at the Event. The Controller of personal data collected during the Event is the Organizer. The Controller has appointed a Data Protection Officer you can contact directly by e-mail using the following e-mail address: ochronadanych@esatrucks.eu or by snail mail to the address of ESA Trucks Polska Sp. z o.o. with its registered office in Komorniki, ul. Ks. Wawrzyniaka 1.
  2. The Controller will process the aforementioned personal data for the purpose of documentation and promotion or advertising of the Event and future events of the Organizer, as well as for promotional and marketing purposes of the business activity of the Organizer. The grounds for processing the image of persons participating in the Event is the necessity of processing personal data for purposes resulting from legitimate interests pursued by the Controller in accordance with art. 6.1. (f) of the GDPR. The legitimate interests pursued by the Controller consist in the possibility of distribution of the image of persons as part of the whole Event, so that by promoting the Event and the business activity of the Organizer, further editions of the Event and other artistic and entertainment events organized by the Controller may take place.
  3. Persons participating in the Event acknowledge that in connection with the processing of the aforementioned personal data gathered during the Event, the Controller informs that:
  • the recipient of personal data may be any entity which will be interested in the Event or business activity of the Organizer, including in particular trading partners and clients of the Organizer;
  • these data will be kept for the period of organizing subsequent editions of the Event or for the period of conducting business activity by the Organizer, which is currently impossible to determine;
  • they have the right to request from the Controller access to personal data, their rectification, removal, limitation of processing, opposition to processing (in certain cases defined by law), lodging a complaint to the supervisory body, and the right to data portability and to withdraw at any time the consent to the processing of data by the Controller without affecting the legitimacy of the processing;
  • participation in the Event is synonymous with providing personal data (i.e. recording the image); if the person does not want the Controller to collect their personal data, they should not participate in the Event;
  • When processing personal data, the Controller will not make automated decisions (including profiling) in relation to these data.
  1. The Controller makes every effort to provide all physical, technical and organizational measures to protect personal data against accidental or deliberate destruction, alteration, loss, unauthorized disclosure, use or access, in accordance with applicable law.

V. Final provisions

  1. In matters not regulated by the Rules, the provisions of the Civil Code and other provisions of Polish law shall apply.
  2. Participation in the Event is equivalent to accepting these Rules.
  3. The Rules come into force on the day of their publication on the website on 01.03.2019 and are valid until the end of the Event or matters related to the Event.
  4. The Organizer has the right to change the Rules, in particular due to the need to ensure the proper course of the Event and the safety of persons participating in the Event.
